I'm Sure They Could Find the Pope and Bin Laden Share Responsibility

...for this, if they really wanted to. I mean, they've got just about everybody else.

The father of Josh Hancock filed suit Thursday, claiming a restaurant provided drinks to the St. Louis Cardinals relief pitcher even though he was intoxicated prior to the crash that killed him.

The suit, filed in St. Louis Circuit Court by Dean Hancock of Tupelo, Miss., does not specify damages. Mike Shannon’s Restaurant, owned by the longtime Cardinals broadcaster who starred on three World Series teams in the 1960s, is a defendant in the case along with Shannon’s daughter, Patricia Shannon Van Matre, the restaurant manager.

Other defendants include Eddie’s Towing, the company whose flatbed tow truck was struck by Hancock’s sport utility vehicle in the early hours of April 29; tow truck driver Jacob Edward Hargrove; and Justin Tolar, the driver whose stalled car on Interstate 64 was being assisted by Hargrove.

So, if your car poops out on the highway, make damn sure there's no DRUNKS on the highway miles behind you, because it's your fault if the DRUNKEN bastard hits someone else and miraculously only kills himself.

You can't say I didn't warn you.

I feel for the family for their loss, but the dad is a gold digging pig, he is blaming everyone but his drunk ass son that wasnt responsible enough to know when to stop drinking. if he raised him to be responsible this would have never happened...

thank you mike. you summed it up in a nut shell. the father is only going for money. instead of maybe litigation fining etablishments whom sell alchol to intoxicated people.. but no.. he just going for the money. Blame everyone but the high profile dunken idiot who managed to kill himself.. thank god none of the other two victims of the accident were seriously injured. If anything I feel sorry for them, and the families...

This lawsuit just goes to prove a point the world is ruled by greed.

The dad forgot to name the dealer who gave his son the marijuana and what was the glass pipe for????

I'll second that "thank you mike." Summed up, indeed.

I am sorry for the family's loss of their son but NOBODY forced this man to drink excessively at the restaurant, forced him to get drunk and forced him to drive while intoxicated at a high rate of speed. What judge would even try this case? The father should be ashamed for bringing such wasted and bad publicity to this already sad situation.

OK. He had a drink in his hands all the time, but just how many was that? I have been to parties for that length and longer with a drink in my hand, but no way would my blood alcohol would be above the legal limit. (I count, but that ability may be beyond that of a professional athelete). Just how many drinks did he have at the restaurant and afterwards?
Also, I do not recall an instance where a tow truck driver coming to my assistance does not turn on his light bar.

This is so ridiculous, he should be happy his dumb ass son did not kill anyone else, otherwise they would be suing the Dad. He is an idiot as well, "apple does not fall far from the tree"....

I too feel bad for the family's loss, but come on their son was a grown man capable of making his own decisions. If he couldn't decide on his own that he had had enough and stop drinking on his own, why is that any one else's responibility but his own? People need to grow up and take responsibility for their own actions! He chose to get wasted, he chose to drive (why not just get a cab??), and now it's no one else's fault but his own. The dad needs to come back to reality and quit trying to blame everyone else for his son's death.
And why isn't the dad sueing every person that bought his son a drink that night too? Just sue everyone and avoid facing the fact that his son killed himself through his own actions.

A warm Swill welcome to you all!!

I've have another thought about the unintended consequences of this dirtball's litigous actions. It would truly, truly be a crime against humanity if the poor schmuck whose car broke down loses his job, goes broke and has to live on the streets because of the lawyer's fees to fight this bullshit lawsuit. His life could very well be on it's way to being destroyed. I hope a good Samaritan barrister steps forward and does it gratis.

I hope...

its so sad what happen but money dont bring him back just makes the dad richer unless he gives the money to help others who has a dringing problem and less not forget the pot problem this so be a lesson to everyone

We don't know all the details, but this goes a long way in understanding what happened as far as I'm concerned:

"He was also speeding, using a cell phone and wasn’t wearing a seat belt, Police Chief Joe Mokwa said after the accident. Marijuana also was found in the SUV."

There may or may not be a legitimate case against the restaurant, I can't tell from that article. The rest of it seems like simple money grubbing. Whatever the decision on the restaurant's culpability, in the end the man got himself killed through his own irresponsible actions. Lord knows I came close enough myself a few times in my younger days. By the grace of God I didn't, and I grew up and stopped in time. He didn't. It is a pity and a tragedy, but his family and estate ought to be grateful he didn't kill or seriously hurt anyone in the process.

I'm surprised he hasn't added Major League Baseball to the list for not addressing his drinking. Corey Lidle's widow is doing the same kind of suit, everybody from the plane manufacturer to MLB.

Hey, sue the Highway Authority, too. Obviously if they hadn't built the road that way this all could have been avoided.

Ah, the always-popular "shotgun" lawsuit.

Posted by: mojo at May 25, 2007 12:13 PM

Hmmmm.

Goodbye personal responsibility.

Posted by: memomachine at May 25, 2007 12:31 PM

But the example of his manager, Tony La Russa, who has been known to pull over and sleep it off because he was driving sloshed? NOTHING TO DO WITH IT. All that beer in the clubhouses, that 99.44% of the guys can consume responsibly? NOTHING TO SEE HERE.

This is more than annoying, this is preposterous. Three words: "Dismissed, with prejudice." Here's to hoping.
