So the N.C. Attorney General Has Done the Right Thing

...and in no uncertain terms:

"...Based on the significant inconsistencies between the evidence and the various accounts given by the accusing witness, we believe these three individuals are innocent of these charges."

Alrighty then. Since Imus got us all prepped and we're in an apologizing mood, where's Rev. Al's and Jesse J's,

"Sorry 'bout that. No malice intended, you understand."
...to the Duke lacrosse players?

I hope the families sue the hell out of Nifong and Duke.

Can't sue Nifong, Mr. B: he has prosecutorial immunity for acts in the scope of his official duties. But I certainly hope he's disbarred, as he should be.

Hmmmm.

But if he's found to have acted 'beyond the scope' of his duties, could something then be done about him?

Nifong is scum, Mr. B., but allowing suits like that would encourage every defendant who isn't ultmately convicted to sue the prosecutor.

There's no credible argument any of this was beyond the scope of his duties: bringing and prosecuting criminal charges is the essence of a prosecutor's duties. A suit against him in his "personal capacity" would be valid for some act like any other alleged tortfeasor, e.g., a battery suit if he'd gone out and actually punched one of the lacrosse players in the face.
